1. About these terms
These terms apply when you use the DawnTracker website, web app, and apps (the "service"). By creating an account or using the service you agree to them. Our privacy policy explains how we handle personal data. Contact: support@dawntracker.com.
2. Your account
- You must be at least 13 years old to create an account.
- You need an account to sync your planner. Give a valid email address and keep your password secure.
- Accounts are personal. You are responsible for activity on your account.
- Tell us straight away if you think someone else has access to your account.
- You can delete your account at any time in Settings.
3. Your content
Everything you add to your planner stays yours. You give us permission to store, copy, and transmit it only as needed to run the service for you, such as syncing it between your devices and keeping backups. We do not use your content for anything else.
4. Acceptable use
Do not use the service to:
- break the law or infringe other people's rights;
- store or share malware or content that is illegal;
- try to access other accounts or data, or probe, overload, or disrupt the service;
- automate sign-ups or resell access to the service.
5. Free plan and Premium
- The free plan includes up to 30 active tasks. Contexts, events, reminders, and sync are included.
- Premium removes the task limit. It is sold as a monthly or yearly subscription at the price shown before you pay. Prices include VAT where it applies.
- Payments are handled by Stripe, or by Google Play when you subscribe in the Android app from Google Play. By subscribing you also accept that provider's terms for the payment.
- Subscriptions renew automatically at the end of each period and are charged to your saved payment method until you cancel.
- If a renewal payment fails, Stripe or Google Play retries it for a short time. If it still fails, your account returns to the free plan.
- If we change the price, we will tell you at least 30 days before it applies to your next renewal, and you can cancel before then.
6. Cancellation
Cancel any time in Settings, Manage subscription. Premium stays active until the end of the period you already paid for. After that your account returns to the free plan. Nothing is deleted, but you cannot add more tasks while you have more than 30.
7. Refunds and your right of withdrawal
If you are not satisfied, email support@dawntracker.com within 14 days of any Premium charge, including renewals, and we will refund that charge in full. No questions asked. Refunds go back to the original payment method.
If you live in the EU/EEA or the UK you also have a legal right to withdraw from a new subscription within 14 days. Our refund promise above covers this right in full. After a refund, Premium ends and the account returns to the free plan.
8. Availability and changes
We work to keep DawnTracker available and your data safe, and we keep encrypted backups. The service may sometimes be unavailable for maintenance or reasons outside our control. We may improve or change features. If we remove something important that you pay for, we will tell you in advance and you can cancel for a pro-rata refund.
9. Suspension and ending the service
We may suspend or close accounts that seriously or repeatedly break these terms, after a warning where reasonable. If we ever stop running DawnTracker, we will give at least 60 days notice, refund unused paid time, and give you a way to export your data.
10. Liability
DawnTracker is a planning tool. Reminders depend on your device, its settings, and your connection, so do not rely on the service alone for anything critical such as medication or safety.
To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer.
11. Changes to these terms
We may update these terms. For important changes we will let account holders know at least 30 days in advance by email or in the app. If you do not agree, you can cancel and delete your account before the changes apply.
12. Law and disputes
Please contact us first and we will try to fix any problem. Mandatory consumer protection laws of your country of residence always apply. EU consumers can also use their national consumer dispute bodies.
